FOODLE APP AND WEBSITE TERMS OF SERVICE  
Information About Us  
Foodle Sdn. Bhd. is a company registered under the Malaysian Companies Act 2016 with  
the registration number: 20210100229 (1402597-X) ("Company", "we", "us" and "our").  
We operate the Foodle website (the "website"), Foodle webapp (the “webapp”) and the  
Foodle mobile application (the "app", collectively the "Platform") to which these terms are  
applied.

Access to Our Platform (Website and App)  
1.1  
We provide the Foodle Platform for you to browse food offerings and place  
Orders ("Orders") for products ("Products") from our licensed third-party  
brands and in-house brands. In using the Platform, you may be required to  
submit personal details ("Information").  
1.2  
Certain parts of our Platform are accessible without placing an Order. By  
accessing any part of our Platform, you agree to these terms. If you do not  
agree with these terms, you should immediately leave the website, close the  
app, and refrain from placing any Orders.

We reserve the right to amend these terms at any time. Updated and/or  
amended terms shall always be available on the Platform, and shall be in  
force and binding whenever you place an Order or use our services.  
While we aim to ensure our Platform is available 24/7, we are not liable if  
either platform is unavailable due to maintenance, system failure, or other  
reasons. Access may be suspended at any time without notice.

Ordering on Our Platform  
2.1 You can use our Platform to place Orders for collection in-store, for table  
Ordering (dine-in), or for delivery by our third-party delivery partners, where  
available (depending on the restaurant selected). The Platform also offers  
convenience features such as an AI agent for personalized recommendations  
based on your usage data.  
Placing an Order  
2.2  
To place an Order through our Platform, you must be 18 years old and above.  
Minor Usage Policy  
2.3  
If you are below 18 years old, you may only use the Platform and place  
Orders with the active supervision and explicit consent of a parent or legal  
guardian. By placing an Order, you confirm you meet this age requirement or  
have the necessary consent.  
2.4  
Before confirming your Order, ensure all information submitted is accurate.  
Once an Order has been placed and payment processed, it is generally not  
possible to change the Order. For additional items, you shall need to place a  
new Order.

If an error occurs, please contact the restaurant directly, as the restaurant  
personnel may be able to assist.  
Orders can generally be placed for same-day service unless specified  
otherwise (e.g., pre-Orders).

3.  
Your Information and Account  
3.1  
To use certain features or place an Order, you shall need to provide your  
name, date of birth, contact number, email address, and potentially other  
details as required to enable us to provide you with better services. Payment  
information shall be processed by our payment provider and shall not be  
stored by us.  
Your Account  
3.2  
You must be at least 18 years old to create an account and place Orders  
through our Platform. When creating an account, you shall be required to  
provide a password.  
3.3  
Do not share your password with third parties. You are responsible for all  
activities conducted through your account. If you suspect someone else has  
access to your account, notify us immediately via our customer support  
contact points. It is your responsibility to ensure your password is secure.  
3.4  
We reserve the right to disable or remove accounts at any time if we suspect  
a breach of these terms or fraudulent activity. Should you wish to delete your  
account, please contact us, and we shall process your request.

Payment  
4.1  
You shall be charged the prices displayed during the Ordering process on our  
Platform, inclusive of applicable taxes. There shall be additional charges for  
delivery service, which shall be provided through third parties, if  
necessary/available.  
4.2  
Payment is required before collection, dine-in service, or delivery (if  
necessary/available). If your payment is not authorised, the Order shall not be  
processed.  
5.  
Cancellations and Refunds  
5.1  
Once an Order has been confirmed, payment has been processed, and you  
have received your Order confirmation number, it shall not be possible to  
amend or cancel the Order. For changes, please contact the restaurant  
directly, and the restaurant personnel may be able to assist.

If we or the restaurant are unable to fulfil your Order for whatever reason, we  
shall refund you for the unavailable items. To request a refund, please contact  
customer services via our provided contact channels.  
If you believe your Order is not as described, please contact customer  
services immediately with evidence.

Delivery Services

Foodle does not provide the delivery services itself.  
We are a platform that integrates with independent third-party delivery  
partners, to facilitate the delivery service you request.  
6.3  
We shall not be liable for the acts, omissions, delays, or negligence of these  
third-party delivery partners. Once the Order leaves the restaurant with the  
delivery partner, the risk passes to you, and any disputes regarding delivery  
should be directed to the delivery partner or restaurant, where appropriate.

Products, Allergens, and Nutrition  
7.1  
We strive to ensure that the information, including nutritional facts, allergens,  
and descriptions, on our Platform is accurate based on data provided by our  
restaurant partners, but we cannot guarantee it shall always be correct or  
complete. We may update content at any time without notice.  
Allergen and Cross-Contamination Disclaimer  
7.2  
We do our best to provide accurate allergen information; however, since all  
products are prepared in busy kitchens that handle common allergens, we  
cannot guarantee that any specific meal shall be entirely free from allergens.  
There is always a risk of cross-contamination, and we make no such  
warranty.  
Nutritional Transparency  
7.3 We provide a transparent policy of showing the nutritional facts of each menu  
item at the bottom of its description, stating allergens, calories, protein, carbs,  
fat, sodium, etc., for your convenience. For the avoidance of such  
transparency as contained herein shall not be construed as an approved diet.

Disclaimers  
8.1  
The Platform and all its content, products, and services obtained through the  
Platform are provided on an "as is" and "as available" basis.  
8.2  
To the fullest extent permitted by law, we disclaim all warranties,  
representations, or conditions, express or implied, including, but not limited to,  
implied warranties of merchantability, fitness for a particular purpose,  
non-infringement of intellectual property, or accuracy of data.  
8.3  
We make no warranty that (i) the Platform shall meet your requirements; (ii)  
access shall be uninterrupted, timely, secure, or error-free; (iii) the results  
obtained from using the Platform shall be accurate or reliable; or (iv) the  
quality of any products, services, information, or other material purchased or  
obtained by you through the Platform shall meet your expectations.

Limitation of Liability  
9.1  
To the fullest extent permitted by Malaysian law, our total aggregate liability  
arising out of or in connection with the Platform, these Terms, or any Order, if  
any, is strictly limited to the total price paid for the specific affected Order.  
9.2  
Foodle Sdn. Bhd. shall not be liable for any indirect, incidental, special,  
consequential, punitive, or exemplary damages, or any loss of profits,  
revenues, data, use, goodshall, or other intangible losses (even if we have  
been advised of the possibility of such damages) resulting from:  
(a)  
(b)  
your access to or use of or inability to access or use the Platform;  
any conduct or content of any third party on the Platform, including  
without limitation, any defamatory, offensive, or illegal conduct of other  
users or third parties (including restaurants and delivery partners);  
(c)  
(d)  
any content obtained from the Platform; and  
unauthorized access, use, or alteration of your transmissions or  
content.

Indemnity  
10.1  
You agree to defend, indemnify, and hold harmless Foodle Sdn. Bhd., its  
officers, directors, employees, and agents, from and against any and all  
claims, damages, obligations, losses, liabilities, costs or debt, and expenses  
(including but not limited to legal fees) arising from:  
(a)  
(b)  
(c)  
your use of and access to the Platform;  
your breach of any term of these Terms of Service;  
your violation of any third-party right, including without limitation any  
intellectual property, copyright, property, or privacy right; or  
(d)  
any claim that your use of the Platform caused damage to a third  
party.

This defence and indemnification obligation shall survive termination of these  
Terms and your use of the Platform.

Suspension and Termination  
11.1  
Should you breach any of these terms, we reserve our rights to suspend or  
terminate your right to place Orders or use the Platform immediately. You  
shall be notified in writing should this be necessary.  
Changes to the Platform and Terms

We may update the Platform and these Terms from time to time. Material  
changes shall be notified on the Platform. Continued use after changes take  
effect means you accept the updated Terms.  
Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes shall first be  
attempted to be resolved through good faith discussions, followed by  
mediation or arbitration administered by the Asian International Arbitration  
Centre in Kuala Lumpur.
